One of the first questions every overseas buyer asks about Phuket real estate is simple: can foreigners actually own property here? The answer is yes, but the rules differ depending on what you are buying.

Condominiums: Freehold Ownership Is Straightforward

Thailand’s Condominium Act allows foreign nationals to own condominium units outright, in freehold title, in their own name. The main restriction is building-wide: foreign ownership within any single condominium project is capped at 49% of the total saleable floor area, with the remaining 51% reserved for Thai ownership. Because of this cap, popular buildings can sell out their foreign quota, so it is worth confirming availability early in your search.

Land and Houses: Different Rules Apply

Foreigners generally cannot own land in Thailand directly. Villas, pool houses, and other landed property are usually structured in one of a few recognised ways: long-term leasehold (commonly up to 30 years, sometimes with renewal options), a usufruct or similar right of use, or ownership of the building itself separately from the land beneath it. Each structure carries different legal implications, and the right choice depends on your goals, whether that is a holiday home, a rental investment, or a long-term residence.

Why Due Diligence Matters

  • Verify the title deed type (Chanote is the strongest form of Thai land title).
  • Confirm any lease is properly registered at the local Land Office, not just signed privately.
  • Check that a development’s foreign quota has not already been filled before you commit to a condo.
  • Understand who legally holds the land in any leasehold or company-linked structure.
