In Thailand, the title deed is the property. Everything a buyer needs to know about what is being sold, who owns it and what is registered against it begins at the land office. Not All Title Is Equal

Land in Thailand is held under several different documents, and they confer materially different rights. A full Chanote title — accurately surveyed, with boundaries marked and formally registered — is the strongest and the only form we would ordinarily want to see behind a client’s purchase. Lesser documents may confer possessory rights rather than full ownership, may be based on rough or unverified surveys, and may restrict transfer, subdivision or development.

The check begins with an official search at the land office rather than a copy supplied by the seller. That search confirms the current registered owner, the classification and area of the land, the registered boundaries, and the history of previous transfers. It also reveals anything registered against the title: mortgages, charges, servitudes and rights of way, usufructs, superficies, registered leases, or court orders and injunctions.

Access is verified separately, because it is one of the most common problems in Phuket. A plot reached across a neighbour’s land by long-standing courtesy has no guaranteed access at all, and the day that neighbour sells is the day it becomes apparent. A properly registered right of way is a very different thing from an established habit.


Local Restrictions That Catch Buyers Out

Phuket applies planning and environmental controls that are stricter than many buyers expect, particularly on hillside land. Building on elevated and sloping ground is restricted, with limits that tighten as elevation and gradient increase, and there are controls on building heights and setbacks in coastal and protected zones. Land that looks like a spectacular building plot may carry limits on what — if anything — can lawfully be built on it.

So the review extends beyond the deed itself: zoning classification, applicable building controls, existing construction and occupancy permits, whether what stands on the land was actually permitted, and whether any part of the plot encroaches on public land, a waterway or a neighbouring title. Unpermitted construction is not a paperwork problem; it can be an order to demolish.
