Transfer Day at the Land Office

Part 8 of 9

Ownership in Thailand changes at the Land Office, in person, on the day. Everything before it is preparation for a single appointment.

Who attends

Buyer and seller, or their attorneys holding a properly executed power of attorney, along with the documents assembled during due diligence. If a party cannot attend, the power of attorney must be prepared and, where signed abroad, legalised well in advance.

What happens

The officials verify identity and title, assess the taxes and fees due, take payment of them, and register the transfer, endorsing the new owner on the deed. Payment of the price is customarily made at the same appointment, most often by cashier cheque, so that neither side is exposed.

For foreign buyers of condominiums

The Foreign Exchange Transaction form evidencing that the purchase funds were remitted into Thailand in foreign currency is required, along with the juristic person confirmation on the foreign quota. Missing paperwork here stops the appointment.

Afterwards

Utilities and any management agreements are transferred, keys handed over, and the seller retains copies of everything for tax purposes and for any future repatriation of funds.
