Legal Transfer Support for Phuket Property Sales

Ownership of property in Thailand changes hands at the land office, in a single appointment, on the strength of the documents presented that morning. Everything that matters legally happens there. Preparing for the Land Office

Preparation begins weeks earlier. The title deed is checked and confirmed against the land office records, the registered owner’s identity and marital status documentation is assembled, and any mortgage or encumbrance registered against the property is scheduled for discharge on the same day as the transfer. Where a company or a lease is involved, corporate records and lease documents are brought up to date and certified.

For foreign buyers there are additional requirements. Purchases of condominium units by foreign nationals must be supported by evidence that the funds were remitted into Thailand from overseas in foreign currency, and the relevant bank certification has to be obtained in the correct form and in the buyer’s name. Where the unit is being registered within a building’s foreign freehold allocation, the juristic person must issue the certification confirming that capacity remains available.

The lawyers also settle the numbers. Transfer fee, stamp duty or specific business tax, and withholding tax are calculated in advance on the correct basis, the split between buyer and seller is confirmed in writing against what was negotiated, and the funds are prepared in the form the land office will accept. Surprises on the day are almost always the result of these calculations having been left until the day.


On the Day, and Afterwards

Your lawyer attends the transfer with you, or acts under a properly executed power of attorney if you cannot travel — a common and entirely workable arrangement for overseas buyers and sellers, provided the documentation is prepared and legalised in good time. Documents are checked before signature, translated where needed, and the registration is completed and the new deed issued before anyone leaves.

Afterwards there is a short list of matters that are easy to forget and awkward to correct: transferring utility accounts and any house registration record, notifying the juristic person or management company, updating insurance, and retaining the foreign exchange documentation that you will need when you eventually sell and wish to repatriate the proceeds. We make sure that list is completed.
